This Limited Warranty & RMA Policy applies to eligible products sold by Surveying Equipment Metricop LLC through metricop.com, a Metricop quotation, proforma invoice or written order confirmation.
The warranty provider, warranty period and any product-specific conditions may be identified on the product page, quotation, invoice, warranty statement or manufacturer documentation.
This Policy applies only to purchases made on or after the effective date above. It does not change the warranty terms of an earlier order.
1. Who provides the warranty?
A product may include:
-
a limited warranty provided directly by Metricop;
-
a manufacturer’s warranty administered under the manufacturer’s terms;
-
a limited warranty or condition statement specific to pre-owned equipment; or
-
only the mandatory legal rights that apply to the purchase.
The applicable product page or Order Document should identify the warranty offered.
Where a product is advertised or quoted simply as including a “1-year warranty” without identifying another warranty provider or different terms, Surveying Equipment Metricop LLC provides a 12-month limited warranty beginning on the date the product is delivered to the original Buyer.
Where a manufacturer is identified as the warrantor, the manufacturer’s warranty terms control. Metricop may assist with coordination, but does not expand the manufacturer’s obligations unless Metricop expressly agrees in writing.
Mandatory rights against the legal seller remain unaffected.
2. Products covered
This Limited Warranty applies only to the product and included components expressly identified as covered in the applicable product page or Order Document.
Accessories, batteries, chargers, software, subscriptions, licences, consumables and third-party components may have different warranty periods or providers. Their coverage will be stated separately where applicable.
The warranty is provided to the original Buyer. Any transferability required by mandatory law remains unaffected.
3. What the Metricop limited warranty covers
During the stated warranty period, Metricop warrants that a covered product will be free from material defects in materials and workmanship under normal, intended use and will materially conform to the express written specifications applicable to the sale.
A product is not defective merely because a newer model, software version or feature becomes available after purchase.
4. What is not covered
Unless mandatory law requires otherwise, the limited warranty does not cover:
-
normal wear and cosmetic deterioration;
-
accidental damage, impact, crushing, dropping, fire, liquid ingress or improper transport;
-
misuse, abuse, negligence or use outside the published operating conditions;
-
incorrect installation, setup, storage, charging, maintenance or cleaning;
-
use with incompatible accessories, software, power supplies, radio settings or third-party products;
-
unauthorised repair, modification, disassembly or removal of serial or security labels;
-
damage caused by malware, corrupted files, network failure, power surge or external electrical supply;
-
data loss, lost project files, configuration loss or interruption of cloud services;
-
consumables and parts expected to wear during normal use;
-
batteries beyond the separate battery warranty, or normal reduction in battery capacity;
-
periodic calibration, adjustment, cleaning or preventive maintenance;
-
loss of accuracy caused by impact, improper handling, environmental exposure or failure to perform required calibration;
-
software, firmware, subscriptions or digital services governed by a third-party licence or service agreement;
-
damage caused by events outside reasonable control, including flood, lightning, fire, war or natural disaster; or
-
a defect or condition disclosed in writing before the sale of pre-owned equipment.
The warranty does not guarantee that a product will satisfy an application, accuracy requirement, software environment or workflow that the Buyer did not disclose and Metricop did not expressly confirm in writing.
5. Pre-owned equipment
Pre-owned equipment is covered only by the warranty or condition statement expressly supplied for the specific unit.
Normal signs of prior use and disclosed defects are not warranty claims.
If a pre-owned product is expressly sold in writing “as is” or “with all faults” to a Business Customer, it is covered only by the express condition statement or limited warranty, if any, provided in writing.
Mandatory Consumer rights remain unaffected.
6. Before requesting warranty service
The Buyer should stop using a product where continued use may cause damage, create a safety risk or make the reported problem worse.
Before return authorisation is issued, Metricop may reasonably request that the Buyer:
-
install an approved update;
-
verify settings, licences, cables, batteries or accessories;
-
provide diagnostic files, screenshots, photographs or video;
-
test the product using documented troubleshooting steps; or
-
participate in remote technical support.
Troubleshooting does not extend the warranty period unless Metricop expressly confirms an extension in writing or applicable law requires it.
7. How to make a warranty claim
Contact sales@metricop.com promptly after discovering the problem and provide:
-
order, quotation or invoice number;
-
Buyer name and company;
-
product name, model and serial number;
-
date the problem began;
-
clear description of the problem and circumstances;
-
photographs or video showing the issue;
-
photographs of packaging and shipping labels if transport damage is involved; and
-
troubleshooting information reasonably requested by Metricop.
Claims submitted after the warranty period may still be considered where mandatory law applies or where the Buyer reported the defect within the warranty period.
8. RMA authorisation is required
Do not return any product until Metricop issues written RMA approval and return instructions.
The authorised service or return location may be operated by Metricop, a manufacturer, supplier or authorised service partner and may be in a country different from the original delivery country.
Do not send products to Metricop’s registered address, a previous shipping address, Elemtech AB, Metricop d.o.o., a supplier or any other location unless that exact address is stated in the RMA instructions.
Unauthorised returns may be refused, returned to the sender or held at the sender’s cost.
9. Preparing a product for return
Before return, the Buyer must:
-
back up and remove confidential or personal data where possible;
-
sign out of personal accounts and disable device locks;
-
remove accessories not requested in the RMA;
-
include the requested components, cables and proof of purchase;
-
package the product securely for international transport;
-
use a trackable service and retain proof of shipment; and
-
follow the customs wording and declared-value instructions provided with the RMA.
Metricop and service partners are not responsible for loss of data during inspection, repair, replacement, reset or software installation.
The Buyer must not send hazardous, damaged or recalled batteries unless the carrier and RMA instructions expressly permit it.
10. Warranty transport costs
For Business Customers, return-to-base warranty service applies unless the Order Document states otherwise. The Business Customer is responsible for insured transport to the authorised service location. If the claim is validated, Metricop will pay the reasonable cost of returning the repaired or replacement product to the original delivery country, unless different terms were agreed.
Metricop may provide a prepaid label, arrange collection or reimburse reasonable transport where it expressly agrees to do so.
For Consumers, transport, repair and replacement costs will be allocated as required by the mandatory law applicable to the purchase. A Consumer will not be charged costs that the legal seller is required to bear for a valid statutory conformity claim.
The sender is responsible for accurate customs documentation identifying the shipment as returned goods. Duties, taxes or brokerage caused by incorrect documentation may be charged to a Business Customer where permitted.
11. Inspection
Receipt of a returned product does not by itself confirm warranty coverage.
Metricop or the authorised service provider will inspect and test the product. If no covered defect is found, or if the issue falls within an exclusion, Metricop may provide a diagnostic report or a quotation for non-warranty repair.
For Business Customers, reasonable inspection, return and transport costs may be charged when the claim is not covered, provided those costs are disclosed before chargeable work proceeds.
No chargeable repair will be performed without the Buyer’s approval.
12. Warranty remedies
For a valid covered claim, Metricop may, depending on the product, defect, applicable warranty and mandatory law:
-
provide troubleshooting, a software update or a missing component;
-
repair the product;
-
replace it with the same model or a functionally equivalent product;
-
provide an appropriate price reduction or credit; or
-
refund the price paid for the affected product.
A replacement may be new or professionally refurbished where legally permitted and must provide materially equivalent functionality.
If repair or replacement cannot be completed within a reasonable time, Metricop will provide another remedy required by applicable law or the written warranty.
For Business Customers, repair, replacement, appropriate credit or refund of the affected product is the exclusive remedy to the maximum extent permitted by law. If that remedy fails of its essential purpose, the remedies available under applicable law apply.
13. Replacement products and parts
Unless mandatory law requires a longer period, a product repaired or replaced under a Metricop limited warranty remains covered for the longer of:
-
the remainder of the original warranty period; or
-
90 days after the repaired or replacement product is delivered.
Replaced products or parts become the property of Metricop or the warranty provider where permitted by law.
14. Processing time
Repair and replacement times are estimates and depend on diagnostics, parts availability, manufacturer response, transport and customs clearance.
Metricop does not guarantee a repair date unless it expressly agrees to one in writing.
Loan or advance-replacement equipment is not included unless expressly stated in the Order Document.
15. Limitation for Business Customers
The warranty disclaimers, exclusive remedies and limitation of liability in the Commercial Sales Terms – Business Customers Only section of the Terms & Conditions apply to Business Customers.
To the maximum extent permitted by law, Metricop is not liable to a Business Customer for project delay, downtime, rental equipment, lost data, lost profit, survey rework or other indirect or consequential loss arising from warranty service or product unavailability.
16. United States Consumer rights
This is a Limited Warranty, not a Full Warranty.
For a U.S. Consumer purchase covered by a written Metricop warranty, any implied warranties that cannot be disclaimed, including merchantability and fitness for a particular purpose, are limited to the duration of this written warranty to the extent state law permits.
Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so an applicable limitation or exclusion may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
17. EU, EEA and UK Consumer rights
This commercial Limited Warranty is additional to, and does not replace or reduce, mandatory statutory rights.
Where EU Consumer law applies, the legal seller remains responsible for the legal guarantee of conformity for the applicable statutory period, which is generally at least two years for new consumer goods and may be longer under national law.
Where UK Consumer law applies, statutory remedies for goods that are faulty, not as described or not fit for purpose remain unaffected.
